1. ABOUT WAVEFORM POWER GROUP

Waveform Power Group, LLC (“Waveform Power,” “we,” “us,” or “our”) provides electrical engineering, electrical contracting, inspection, infrared thermography, maintenance, consulting, project-management, and related services.

The availability and scope of any service depend on the specific project, location, applicable licensing requirements, permitting requirements, site conditions, and the terms of a separate written agreement.

2. INFORMATIONAL PURPOSE OF THE WEBSITE

The Website is provided for general informational, marketing, and business-development purposes.

Information presented on the Website is intended to provide a general overview of our company, qualifications, experience, and services. Website content is not intended to constitute:

  • Professional engineering advice;

  • Electrical design or construction instructions;

  • A professional engineering opinion;

  • An inspection, certification, or evaluation;

4. SEPARATE PROJECT AGREEMENTS

All engineering, construction, inspection, thermography, maintenance, consulting, and related professional services are governed by a separate written agreement.

That agreement may address matters including:

  • Scope of services;

  • Fees and payment terms;

  • Deposits and retainers;

  • Project schedules;

  • Client responsibilities;

  • Site access;

  • Existing conditions;

  • Permitting and governmental approvals;

  • Utility coordination;

  • Construction means and methods;

  • Deliverables;

  • Ownership and permitted use of drawings or reports;

  • Warranties;

  • Limitations of liability;

  • Insurance;

  • Suspension or termination;

  • Dispute resolution; and

  • Other project-specific requirements.

If these Website Terms conflict with a separately executed agreement between you and Waveform Power, the executed agreement will control with respect to the applicable project or services.

5. REQUESTS, ESTIMATES, AND PROPOSALS

Any preliminary discussion, budget estimate, anticipated schedule, service recommendation, or other information provided before completion of an appropriate review is nonbinding unless expressly incorporated into a signed agreement.

Pricing, schedules, and recommendations may change after reviewing project documents, site conditions, existing electrical systems, permitting requirements, utility requirements, material availability, labor availability, or other relevant information.

Waveform Power reserves the right to accept or decline any project request at its sole discretion, subject to applicable law.

6. EMERGENCIES AND UNSAFE CONDITIONS

The Website is not an emergency reporting or emergency-response service. Website forms, emails, and voicemail may not be monitored continuously.

Do not use the Website to report an active electrical emergency, fire, electrical shock, arcing, smoke, exposed energized equipment, downed electrical conductors, or any condition presenting an immediate threat to people or property.

For an immediate emergency, call 911 and contact the appropriate electric utility, fire department, property emergency contact, or qualified emergency electrical service provider.

Do not approach, touch, move, operate, or attempt to repair electrical equipment that may be energized or unsafe.

7. ACCURACY OF WEBSITE INFORMATION

This provision does not apply to the extent a claim results from conduct for which indemnification cannot legally be required.

18. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising solely from use of the Website will be brought in a state or federal court having jurisdiction in Miami-Dade County, Florida.

Project-specific disputes may be governed by the dispute-resolution and venue provisions contained in the applicable signed agreement.

19. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

20. NO WAIVER

Waveform Power’s failure to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision in the future.

21. ENTIRE AGREEMENT REGARDING WEBSITE USE

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Waveform Power regarding use of the Website.

They do not replace or modify any separately executed agreement for professional or construction services.
